I was saddened this morning to learn of George Carlin's death from heart failure.
As a college student in the 1970's (with a major in Radio-Television-Film and a minor in Journalism), I was a big fan of George -- both for his brilliant comedy and for his fight for his First Amendment rights of freedom of speech. Of course, I had watched him perform traditional standup comedy on his many appearances on The Ed Sullivan Show. But I got hooked as an 18-year-old, when I got to see him live at a show in Pauley Pavilion.
He had me with a routine he did on Oxymorons... like JUMBO shrimp... and MILITARY intelligence. (This was at the tail end of our involvement in Vietnam.)
I'm not good at remembering jokes, but 34 years later, I still chuckle ruefully at that observation. Too bad it still rings true.
In February 1975, one of my college instructors announced that Carlin would be appearing on a TV show taping at NBC in nearby Burbank, and anyone who wanted to be in the audience could watch for free. I gathered a few of my friends together and we showed up at NBC -- only to discover that I was supposed to have RSVP'd, or something -- the show had begun and the guard would not let us in.
He did, however, let on that Carlin had just left the building for a moment and would return, and if we wanted to stick around for a few minutes, we might be able to ask him for an autograph. In the meantime, he told us stories about how he moonlighted as a security guard on Bob Hope's estate (and that Bob never went anywhere without a golf club).
We were about ready to pack it in when Carlin returned, with a man I assumed was his manager. They both reeked of marijuana.
He did not give us his autograph... but instead, he did about five minutes of his comedy routine --just for us, by the security desk at NBC. We left Burbank feeling stoked, as this personal encounter was way better than being part of an audience for a TV taping.
Several years later, I briefly worked with George's older brother Patrick as a writing partner. We never finished the spec sitcom script we were attempting to write - the chemistry just wasn't there. But Patrick was a lovely person -- and (in the opinion of some of the Tonight Show guys, who had arranged our introduction) even funnier than George. I learned a lot about the rough and tumble way the Carlin boys grew up. And I gained a more nuanced look at the way they approached comedy.
George Carlin is most famous for the Seven Dirty Words You Can't Say on Television, which was the subject of obscenity arrests and a major FCC ruling. Times have changed - but even if the words no longer carry the same shock value, the rhythm of the routine - and George's expressions and body language - illustrate perfectly why he's mentioned as an influence on so many comedians today.

Ah, the 1940's when things were milder, and voices oozed from wireless and gramophones, and doors were held open, and people stood for the National Anthem, and everyone was so refined...except for the odd matter of a world war, of course.

This morning I came across this very interesting site with snatches of sounds from the forties. I wanted to hear Lord Haw Haw (who was actually three different people according to Wikipedia), but ended up hanging around long enough to hear the doodle bug and 'a heavy air raid' too. They are both really evocative. I could easily imagine my mother listening to this. She was too young to be frightened, she says - all that mattered was that her parents were with her.

The Lord Haw Haw recording is quite moving. My grandmother did a particularly good Lord Haw Haw - pinching her nose to get his upper class nasal drawl: 'Germany calling, Germany calling, Germany calling...' Apparently 6 million people listened to him - I suppose perhaps because they were advised not to - never fails, that one!

Lord Haw Haw's (or William Joyce's) last broadcast is dramatic. He is obviously drunk. He gives a final defiant 'Heil Hitler' before promising to return in a few months and fading away. But he is followed by the man from the BBC (who actually sounds a bit like Lord Haw Haw, but somewhat crisper) and tells the long-suffering listeners that William Joyce 'has been most unfortunately interrupted in his broadcasting career, and has left rather hurriedly on vacation - a very short vacation if the second British army has anything to do with it...'

It must have been a joyous moment.

Lord Haw Haw was later captured and hung for treason.

In honor of Gay Pride weekend here in NYC, its time to revisit the groundbreaking Brokeback Mountain.
Annie Proulxs short story, Brokeback Mountain, first appeared in The New Yorker in 1997. The tentative love story of two cowboys (Heath Ledger and Jake Gyllenhaal) in the 1960s played against stereotypes and caused a sensation. (The story later capped Proulxs 1999 collection, Close Range: Wyoming Stories, which was shortlisted for the Pulitzer Prize.)
Producer and co-writer Diana Ossana and Pulitzer Prize-winner Larry McMurtry (Lonesome Dove) fleshed out the spare story, adding the wives (Michelle Williams and Ann Hathaway). Director Ang Lee (Sense and Sensibility, Crouching Tiger, Hidden Dragon) proved to be a masterful stroke.
Lee brings subtlety and sophistication to the story, eliciting top-notch performances all around. Rodrigo Pietros stunning cinematography (with Canada substituting for Montana) and Gustavo Santaolallas guitar-driven, Oscar-winning score add to the poignancy of the love story.
Santaolallas music makes a distinct impression, due to his duties as music producer, writer and instrumentalist. In addition to composing the score, he co-wrote songs performed by Mary McBride, Jackie Green, Teddy Thompson, and Emmylou Harris. The latters song, A Love That Will Never Grow Old (lyrics by Bernie Taupin), won a Golden Globe as Best Song but was ineligible for Ocar consideration because of its short screen time.
Santaolalla began working on the score after reading the script and the short story. Ninety-nine percent of the musicI wrote before the movie was shot. He sent Lee some of his ideas after their original conversation. He thought I was sending him stuff I had previously composed, and so he told [Brokeback producer] James Schamus, What a pity we cant use this, it would be perfect for our movie. And then James said, But Gustavo did write this for us.(Lee and I) both had the idea for acoustic guitar and strings, Santaolalla said. I thought it would be great to have one more element. That element was the pedal steel guitar. On the soundtrack, the instrument is played by Bob Bernstein, former Senior Vice President of Corporate Communications at Universal Music Group, whose earlier gig as an in-demand country music sideman served him well on the score.
The Hollywood Reporter said the film benefits enormously from [the] melodic and plangent score. Variety gave the score faint praise, calling it conventionally supportivenicely abetted by a host of period and setting-appropriate tunes. Michael Phillips from the Chicago Tribune, however, wished Santaolalla had restrained himself: Once Ennis and Jack get off on their own the movie nearly drowns in orchestral strings.
From its initial successes at the Venice, Telluride, and Toronto film festivals, Brokeback Mountain rode a wave of critical and surprising audience attention. The fact that it won more critic awards for Best Picture than any other film of 2005 makes its Oscar loss to Crash that much more perplexing and frustrating.
Theres no doubt that Santaolallas brief score rode in on the Brokeback stampede. His win has caused much karping on film score message boards, second only to his win the following year for Babel. Whether or not Santaolalla deserved his Oscar is up for debate. Whether or not the music poignantly captured the characters loneliness, wide open spaces, and a love that will never grow old is not.

I was quite mean with my ex-husband really. At the end, when I'd already left him. I was very hard and very direct. He'd hurt my feelings for almost the entire time we'd been together, I could write pages and pages of examples where he was disrespectful, abusive, threatening, bullying and just plain awful. But when I left the family home, and I left the state and he knew, finally, he'd gone too far then our roles were reversed. He became the weeping, pleading, bargaining, weaker spouse. HE became the one crying into the telephone begging for understanding and kindness. But I couldn't show him any. I would simply say No. No I am not coming back. No I don't want to give you another chance. No I am not wanting to try again.

I was pregnant then..9 weeks pregnant with our third child. I probably think it was the hormones that made me so absolutely focused and determined to get my children and get out of that marriage. I could only see ahead... a place of my own, me raising them on my own in safety and support. No ogre ranting and raving and making me feel shut in a box. I would be independent and really get a chance to live life how I wanted to.

When I returned to the area where he lived, about two months after the split, he started coming over. "I just want to sit with you," he'd say. "Can I rub your tummy? Can I talk to the baby?"
He would curl up with me on the couch, after putting the other two to bed with kisses and hugs and I guess he was trying to find a way to get his family to come back. But I knew it was not going to happen.
"We are not coming back," I'd say, "Find yourself a new girlfriend and get on with your life."

I was in turmoil but I was also very focused on what I had to do. And I had to get Nevin to move on in his own life so that he would allow me to make a new one for myself. It's been over six years now and I don't see that changing anytime soon.

One morning however, at about 3am... I got scared by noises outside. A tree was scraping along a window...the wind was howling and I was sweating buckets of fear. My little rented house faced an open paddock and I imagined all sorts of people out there in the long grass watching and spying.
I called my ex-husband. "Can you come over please? I'm really very scared, something keeps banging on the windows."

"On the couch," I replied.
"Nup, not doing it. I'm not coming over there to sleep on a couch."
"Are you kidding me? You're not going to help me?"

His mobile phone alarm went off at 5am. It woke both of us up. In the very faint light of the day, when it was still so quiet in the house, his arm reached across and began stroking my back.

That we would have some liberal version of a modern day mobile family unit. Ha!
Nevin could barely disguise his resentment and bitterness at me once he got a new partner. I became 'the ex' ' the one who was having a child without his blessing'. The selfish one. The user. The cold hearted woman he barely knew.

Once I had our baby ( our beautiful, sunshiny baby) my strong and focused self went away. Faaaar away. I was now a bag of jelly, unsteady, wobbly, sensitive and tender. I cried buckets away. I hung nappies out on a clothes line and howled with the world I had created for myself. There was no tough, free, wild independent spirit to be found.
Our roles reversed all the way back again....but that is another story.

(FranchisePick.Com) If a franchisee fails in the second year of their 10 year franchise agreement, odds are the franchisor can hold them responsible for the estimated future royalties on the remaining 8 years of the contract.
While rarely collected, the threat of future royalties can be a big stick used to demand a reduced farewell failure fee, a release from liability agreement and/or a confidentiality agreement (gag order) to make sure failed franchisees go away quietly.
Troubled franchise companies will sometimes offer some or all of their unhappy or struggling franchisees this type of deal and the chance to buy their way out of their franchise agreements - and their obligations to pay royalties for the remainder of their term (even if they fail).
What does this mean when a franchisor initiates this type of deal? Are these franchisees being asked to pay to give up their rights? Should franchisees ever take such a deal, or are these offered by desperate franchisors who have no intention - or grounds - to sue anyway? Please feel free to comment below.

Make Take Gourmet: The troubled meal prep franchisor, with four recent franchise closures and strong likelihood of being sued, is reportedly offering the remaining 10 or so franchisees a chance to buy their way out of their franchise agreements for $10,000. Dream Dinners: According to commenter PissedDDOwner: Dream Dinners, Inc. said that if I pay them $30,000 and sign a legal paper that I wont sue I can get out of my contract. (I am just learning that other owners have been told this but they haven’t paid) What is my legal right?
Curves for Women: Curves has a standard $10,000 failure fee that allows failing franchisees to close their doors and be absolved of the liability for future royalties if they sign the release and pay the fee before going their merry bankrupt way. So much for being in business for yourself but not by yourself.
Past offers:
Cuts Fitness for Men: Cuts Fitness allegedly gave their struggling franchisees a choice of buying out of their agreements for a couple thousand, or staying in and doing mandatory upgrades of $20K+. All took the former agreement and either continued to use the CUTS name, or changed it.
